II. CONTEST ENTRY PERIOD: The “Question Beauty Contest” (“Contest” or “Promotion”) begins at 12:01 a.m., Eastern Time (“ET”), April 14, 2014 and ends at 11:59 p.m., ET, April 28, 2014 (the “Contest Period” or “Entry Period”). PARTICIPANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.
III. ELIGIBILITY: The Contest is open only to permanent legal residents of the forty-eight (48) contiguous states of U.S. and District of Columbia (“D.C.”), who are ten (10) years of age or older at time of entry. Officers, members, directors and employees of Ananya LLC, and any of their respective parent companies, affiliated companies, subsidiaries, dealers, franchisees, licensees, distributors, suppliers, subsidiaries, advertising / promotion / judging agencies, persons engaged in the development, production or distribution of materials for this Contest (collectively, the “Released Parties”); and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or “step” of each) and those living in the same households of each (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest) are not eligible to participate. All federal, state and local laws and regulations apply. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed or otherwise restricted by law.
IV. REGISTRATION AND SUBMISSION STEPS:
a) Visit The Best Question Ever (“TBQE”) www.tbqe.io to sign up to participate in the “Question Beauty Contest” Follow the prompts to enter your birth date and create a User Name and Password. If you are a minor (for this Contest a minor is the age of 13 or younger at the time of entry) your parent or legal guardian’s name and contact information must be provided prior to completing your registration. When your parent or legal guardian has given their consent for you to join by clicking “Approve”, you will be
able to complete your registration.
b) Enter your TBQE Username and follow the prompts to validate your account.
Then go to “Settings” in the main menu to choose your avatar and to create a profile. Browse the Qs to find friends and people who share your interests. Like! Favorite! Follow!
c) Enter your TBQE Username
d) Then follow the links and instructions to create and submit a Question and or Answer (“Submission”) pertaining to the subjects of: inner beauty; self esteem; keeping it real; turning the idea of beauty inside out; how to feel beautiful; how to support friends and family in their effort to feel beautiful inside and out; how media can improve their depiction of girls and women to be more realistic; how boys really see girls; how moms can support daughters’ self images by improving on their own; or any other subject that represents your thoughts about beauty. Upon completion of registration and your Question or Answer Submission, you are deemed a Contestant (“Contestant” or “You”) in this Contest. Contestants are encouraged to be creative and showcase your personality and thoughts.
e) Your Question or Answer Submission should not exceed 250 Characters. Contest Submissions must not be inappropriate, indecent or obscene, as determined by Sponsor and Co-Sponsor in their sole discretion. Proof of submission or sending is not proof of receipt by Sponsor or Co-Sponsor. All Contest Submissions become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt, and publish any or all of the submitted Questions or Answers, and may use them in any media without attribution or compensation to the Contestant, his or her successors or assigns, or any other entity. The entry of a Contest Submission constitutes Contestant’s irrevocable assignment, conveyance, and transference to Sponsor of all right, title, and interest in the entry, including, without limitation, all copyrights. In addition, by entering, Contestant represents and warrants that the Contest Submissions submitted: are your own original creations; do not infringe on any other person’s or entity’s rights; have not been submitted previously in a contest of any kind; fit with the overall theme of the Contest; and be in keeping with the Sponsor’s image.
Entrants may submit multiple entries. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the Contestant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
V. TERMS AND CONDITIONS OF SUBMISSIONS: Any personal information supplied by the Contestant in connection with this Contest will be subject to the Sponsor’s website’s Privacy Policy (www tbqe.io and fairygodmotheracademy.com). By entering, Contestants warrant that his or her questions and answers about beauty and all elements thereof satisfy the Terms and Conditions of Ananya LLC. PERSONS UNDER THE AGE OF 13 MAY NOT PARTICIPATE WITHOUT WRITTEN CONSENT OF THEIR PARENT OR LEGAL GUARDIAN. Sponsor reserves the right to request a proof of these permissions in a form acceptable to Sponsor from any Contestant at any time. Failure to provide such proof may, if requested, render Submission null and void. Contestant irrevocably grants Sponsor and Co-Sponsor and their respective agents an unlimited, worldwide, perpetual, unconditional, gratis license and right to edit, modify, adapt, distribute, stream, post, publish, broadcast, reproduce, encode, store, copy, transmit, publicly display, exhibit, and or otherwise use or reuse (without limitation as to when or to the number of times used) the Submission and all elements thereof, in whole or in part, including any persons or likeness embodied therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion) in any way, and may use Submission in any and all media, now or hereafter devised, without attribution, compensation, permission or notification to the Contestant, or any other entity, and without notice, review, or approval from Contestant or any other entity. Should Sponsor edit any such Submission elements, Contestant is not relieved from responsibility for compliance with the Sponsor’s Terms of Use and these Official Rules. Upon Sponsor’s request, each Contestant must provide a signed written personal release and/or license/ assignment from (1) Contestant, authorizing use of the Submission in Sponsor’s and Sponsor’s designees’ editorial publications, advertising, marketing and promotions in any and all media now known or hereafter known throughout the world in perpetuity, without additional compensation, permission or notification, unless prohibited by law. All releases must be in the form provided by Sponsor. Contestant must provide fully completed documentation within five (5) days of the date notice or attempted notice is sent. Failure to provide such releases upon request may result in disqualification and the Contestant, whose Submission receives the next highest voting score may be deemed the alternate potential winner for the applicable prize. Released Parties (as defined below) are not responsible for lost, late, incomplete, invalid, un-intelligible, garbled, delayed, inaccurate or a misdirected Submission, Submission not uploaded in accordance with instructions, or Submissions not received for any reason; all of which will be disqualified. Sponsor and Co-Sponsor reserve the right to, but are not obligated to, monitor/screen entries prior to posting them to the Contest Site. BY SUBMITTING A SUBMISSION, CONTESTANT ACKNOWLEDGES THAT HIS/HER SUBMISSION MAY BE POSTED ON THE CONTEST WEBSITE LOCATED AT WWW.TBQE.IO OR OTHER WEB SITE (S) AUTHORIZED BY SPONSOR FOR THE CONTEST (COLLECTIVELY “THE WEB SITE”), AT SPONSOR’S DISCRETION AND CAN BE VIEWED BY OTHER WEB SITE USERS. SPONSOR MAKES NO REPRESENTATIONS, WARRANTIES OR GUARANTEES WHATSOEVER (EXPRESS OR IMPLIED) OF ANY KIND, INCLUDING THAT A CONTESTANT’S SUBMISSION WILL APPEAR IN ANY PUBLIC MEDIA, OR THAT WINNER WILL RECEIVE OTHER BENEFITS OF ANY KIND BY VIRTUE OF THEIR PARTICIPATION IN THIS CONTEST.
In addition, if you remove or edit any Submission before the expiration of the applicable Beauty Question or Answer Submission Period, such Submission shall no longer qualify to participate in the Contest and you will be required to re-post your Submission in order to make any additional Submissions for the Contest. This Contest may be cancelled in the event an insufficient number of qualified Submissions are received that meet the minimum standards established by the Sponsor, Co-Sponsor and or Judges. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Contestants. Released Parties and their respective parents, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees, and any Internet access providers (collectively “Released Parties”) are not responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the Sponsor’s website, for problems uploading or downloading any Submission-related materials from the web site, or for late, lost, damaged, misdirected, incorrect or incomplete entry. For purposes of these Official Rules, receipt of Submission occurs when Sponsor and Co-Sponsor ‘s servers successfully receive the uploaded file and record the required entry information including the following: Contestant’s name, street address, city, state, ZIP Code, phone number, email address, date of birth, beauty question or answer and any other information on the Contest website. Certain Submissions may be featured from time to time on the Sponsor’s Website or in advertising during the Contest Period, in Sponsor’s sole discretion; being selected as a featured Submission does not guarantee selection of a Winner in this Contest.
VI. JUDGING GRAND AND FIRST PRIZE CONTEST WINNERS: On or about April 31,2014, one (1) Grand Prize Winner for Best Question Submission; One (1) Grand Prize Winner of Best Answer Submission will be determined by the algorithms within the social media application; Five (5) First Prize Winners for their Question Submission; and Five (5) First Prize Winners for their Answer Submission will be chosen by judges within the Sponsor company, Ananya LLC.
By submitting a Question or Answer Submission, a Contestant acknowledges and agrees that the Sponsor and Co-Sponsor may obtain many Submissions under this Contest and that such Submission may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other Promotions staged and/or sponsored by the Sponsor, and waive any and all claims a Contestant may have had, may have, and/or may have in the future, that any Submissions accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Submission. Except where prohibited by law, each Contestant acknowledges and agrees that the Sponsor and Co-Sponsor do not have now, nor shall they have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to Contestant’s Submission. By entering a Submission, Contestant hereby grants permission for the Submission to be posted on tbqe.io, fairygodmotheracademy.com, Facebook.com or other Sponsor websites. A Contestant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Submissions by third parties. Released Parties do not guarantee the posting of any Submission. Contestants agree that they will not use the Submission for any other purpose, including, without limitation, posting the Submission to any other online social networks, without the express consent of Sponsor in each instance. By clicking on the Submit button, you certify that you have read and agree with these Official Rules. IMPORTANT: Be sure to save your Submission in the original format after uploading it to the Contest Site. If you are selected as a potential winner, you agree that you will provide Sponsor with your Submission in its original format in order for the Submission to be used in future advertising, PR or Promotions. The Sponsor or Co-Sponsor assumes no responsibility for lost, late, misdirected or damaged entries, including submissions that may be delayed in transmission. No incomplete, illegible or otherwise invalid Submissions will be accepted. Odds of winning a contest prize depend upon the number of eligible entries received. Sponsor reserves the right to select fewer than the stated number of winners, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.
The decisions of the judges are final and not subject to challenge and/or appeal. If Sponsor does not receive a sufficient number of eligible and qualified entries, and/or if any winner fails to respond to phone call or email in two (2) days, Sponsor reserves the right to disqualify any potential Winner and post fewer than twenty-two Winners. If a potential Winner is found not to be eligible or not in compliance with these Official Rules the potential Winner will be disqualified, even if the disqualified potential Winner’s name may have been shown/announced online, and the next highest voted Contestant may be moved up, at the discretion of Sponsor and notified. Except where prohibited by law Sponsor may announce the Winners’ first name and state of residence online. Contest Release Parties shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any person’s participation in the Contest or any prize awarded herein.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. AN ENTRANT IS NOT A WINNER OF THE PRIZE UNLESS AND UNTIL CONTESTAN’S ELIGIBILITY HAS BEEN VERIFIED AND CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
VII. WINNER NOTIFICATION AND PRIZE RELEASES:
Potential Grand and First Prize Winners (“Winner(s)) will be notified by e-mail and/or phone on May 15, 2014 In order to remain eligible, Winner (if a minor, his/her parent or legal guardian) must sign and return by 5:00 pm ET on May 30, 2014, an Affidavit of Eligibility, Release and Indemnification, a Publicity Release (“Prize Acceptance Release”) where allowed by law, as well as other documents that Sponsor may require. Winner (if a minor, his/her parent or legal guardian) agrees that a facsimile copy of such documents shall have the same legal effect as the originals; however, Winner must provide original documents to Sponsor and/or its Administrator prior to issuance of prizes. If potential Winner does not reply to such notification nor return the required documents within the applicable time period (as set forth above) and/or if the e-mail notification is returned as undeliverable after 2 attempts, such potential Winner may be disqualified and an alternate Winner selected.
VIII. CONTEST PRIZES:
• Two (2) Grand Prize Winners will each receive four (4) concert tickets and backstage passes to the Nico Vega All Ages Concert of a Winner’s choice during the 2014 concert calendar year. Prize includes exclusive access to Nico Vega’s sound-check, a backstage tour prior to the performance. In addition, you will personally meet the Nico Vega Band members that includes a photo op. Total Approximate Retail Value (“ARV”) First Prize Pool is $1,500.00.
• Ten (10) First Prize Winners will each have an exclusive online chat with Aja Volkman, lead singer of Nico Vega, and Jan Bozarth of the Fairy Godmother Academy. Prize includes a signed copy of the new album “Lead to Light” and a signed poster. Wisdom is the new Pink T- shirts. Each First Prize ARV is $50.00. Total ARV of First Prize Pool is $500.00
Total of Prize Pool is $2,000.00 (USD).
Prizes will be shipped to the winners per the address provided on the Prize Release form. Invalid and/or incomplete or undeliverable addresses may result in disqualification. Please allow 8 weeks for prize delivery.
IX. CONCERT TICKETS PRIZE CONDTIONS: The Grand Prize is offered specifically by Question Beauty Nico Vega. The prizes of concert tickets and backstage passes to the Nico Vega All Ages Concert (“Concert Event”) are issued so that the concert is closest to the Winner’s residence. The concert tickets must be executed before December 31, 2014. The Winner agrees to accept the ticket dates specified in concert calendar. If the Winner cannot travel on such dates, the prize will be forfeited. The Concert Event awarded consisting of backstage and meet and greet with band members for you and up to three guests require that you and your guest redeem the prize together. Winner must execute liability/publicity release prior to issuance of tickets. If a Winner is a minor, he/she will be required to have his/her parent or legal guardian who is eighteen years of age or older sign and return the Prize Release prior to issuance of tickets. He/she will also be required to have his/her parent or legal guardian who is eighteen years of age or older, accompany them to the Concert Event. If a guest is a minor, the parent or legal guardian who is eighteen years of age or older must sign and return the release. Sponsor will not replace any lost, mutilated, or stolen tickets or certificates. A Winner is responsible for transportation to the Concert Event and if required, hotel accommodations, all tips, gratuities, service charges, taxes, meals, ground transportation not specified, beverages, merchandise, souvenirs and any other incidental costs or expenses not identified in these Official Rules. The Prize is not exchangeable, transferable, or redeemable for cash. Sponsor is not responsible for cancellation or preemption of show/concert/event or for other circumstances that make it impractical or impossible to fulfill these elements of the prize. Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available.
X. GENERAL TERMS & CONDITIONS OF PRIZE: Grand Prize Winners and First Prize Winners (“Winner(s)”) are required to comply with any and all applicable federal, state and local laws, rules and regulations, and the value of any prize awarded to a Winner may be reported for tax purposes as required by law. The Winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive. The Winners of a prize valued over $600 will be required to complete and return an Affidavit of Eligibility/Liability and Publicity Release and will also be required to provide a copy of their passport, driver’s license or birth certificate as proof of age. Each Winner will be required to provide to the Sponsor a valid social security number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 will be issued in the name of the Winner. If the potential Winner fails or refuses to sign and return such Affidavit within the time period required by Sponsor, such potential Winner may be disqualified and an alternate may be selected. Non-compliance shall result in disqualification and award of the prize to an alternate winner. If any potential Winner is found to be ineligible, or if he or she has not complied with these Official Rules, or if the potential Winner cannot participate in any portion of the prize, or declines a prize for any reason prior to award, such potential Winner may be disqualified and an alternate potential Winner may be selected. All properly claimed prizes will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Competition.
A Winner’s acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation.
XI. OPT-IN: By entering the Contest, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Contest. If you opt-in, you authorize the Sponsor to send information via e-mail, to the e-mail address entered on entry form, about its products and services. You may opt out of receiving future e-mails from the Sponsor by clicking on the link contained in any e-mail received. You will remain eligible for this Contest Promotion whether or not you opt out of receiving promotional e-mails from Sponsor.
XII. INTERNET LIABILITY CONDITIONS: If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor and Co-Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Contest Release Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Contest Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Contestant’s or any other person’s computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR AND CO-SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning Submission will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
XIII. DISPUTE RESOLUTION: Contestants agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with the Contest shall be resolved, upon the election by the Sponsor, by arbitration conducted by telephone, online and/or be solely based on written submissions without any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties, pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as selected by the Contestant. IF ANY PARTY WITH RESPECT TO A CLAIM CHOOSES ARBITRATION, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. Unless both the Contestant and Sponsor agree otherwise, the arbitrator may not consolidate more than one person’s Claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and the Contestant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and the entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this paragraph be deemed invalid or unenforceable, then the entirety of this arbitration provision (other than this sentence and the paragraph below) shall be null and void.
If arbitration is not used to resolve a Claim, the entrant AGREES THAT THERE WILL NOT BE A JURY TRIAL. ENTRANT AND SPONSOR EACH UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY CLAIM OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS CONTEST IN ANY WAY. IN THE EVENT OF LITIGATION, THE COURT MAY FILE THIS PARAGRAPH TO SHOW A WRITTEN CONSENT TO A TRIAL. Contestant agrees that this Contest shall be subject to and governed by the laws of the State of Texas, without giving any effect to the principals of conflicts of law, and the forum for any dispute shall be in State of Texas, in the City of Austin, County of Travis.
XIV. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participant, to the extent there is a conflict between these Official Rules appearing any other location and any terms of use or other agreement posted on the Sponsor’s Website, these are the Official Rules to be abided by.
